Gardeners Roehampton Service Terms and Conditions
These Terms and Conditions set out the basis on which Gardeners Roehampton provides gardening and related services to residential and commercial clients. By placing a booking with Gardeners Roehampton, you agree to be bound by these Terms and Conditions. Please read them carefully before confirming any service.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below.
Client means the person, company or organisation requesting the services of Gardeners Roehampton.
Services means any gardening, garden maintenance, soft landscaping, lawn care, hedge trimming, planting, clearance, or other related work provided by Gardeners Roehampton.
Property means the outdoor areas, gardens, grounds, or other locations where the Services are to be carried out.
Agreement means the contract formed between Gardeners Roehampton and the Client once a booking has been accepted and confirmed.
2. Scope of Services
Gardeners Roehampton provides a range of gardening and garden maintenance services across its service area, including routine maintenance visits and one-off projects. The specific scope of work for each booking will be agreed in advance with the Client, either verbally or in writing, and will be confirmed at the time of booking.
The Services may include, but are not limited to, lawn mowing, hedge cutting, pruning, planting, weeding, garden tidy-ups, leaf clearance, and general garden care. Any additional tasks or variations to the agreed scope may be subject to extra charges and must be agreed with Gardeners Roehampton before they are carried out.
3. Booking Process
The Client may request a booking for Services by contacting Gardeners Roehampton and providing the necessary information about the Property, the requested work, and preferred dates and times. Gardeners Roehampton may request photographs, descriptions, or an on-site visit to assess the work required.
A booking will only be considered confirmed once Gardeners Roehampton has accepted the request and provided confirmation of the appointment and, where relevant, the estimated price or hourly rate. Confirmation may be given verbally or in writing. Gardeners Roehampton reserves the right to refuse or cancel any booking at its discretion, for example where access or safety cannot be reasonably guaranteed.
For certain projects, including larger garden overhauls or ongoing maintenance contracts, Gardeners Roehampton may provide a written quotation. Quotations will normally be valid for a limited period as stated by Gardeners Roehampton and may be subject to revision if the information initially provided by the Client is incomplete or inaccurate.
4. Access to the Property
The Client is responsible for ensuring that Gardeners Roehampton and its gardeners have safe and reasonable access to the Property at the agreed time. This includes providing access through gates or communal areas, ensuring that any necessary permission from landlords, managing agents, or neighbours has been obtained, and advising of any site-specific security or entry arrangements.
If Gardeners Roehampton is unable to access the Property due to issues within the Client's control, the visit may be treated as a late cancellation and charges may apply in accordance with the cancellation terms set out below. Gardeners Roehampton is not responsible for delays or failure to complete work arising from lack of access, obstructions at the Property, or adverse conditions that have not been disclosed.
5. Client Obligations
The Client must provide accurate information about the Property and any relevant hazards, including uneven ground, fragile structures, water features, underground services, or the presence of pets or livestock. The Client is required to inform Gardeners Roehampton of any known allergies or sensitivities relevant to the use of horticultural products.
The Client must ensure that the Property is reasonably clear of personal items, waste not related to gardening, and any obstacles that could impede the work. Gardeners Roehampton reserves the right to refuse to handle items that it considers hazardous, inappropriate, or outside the scope of the agreed Services.
The Client agrees not to instruct the gardeners directly to undertake work that is substantially different from, or additional to, the agreed Services without prior approval from Gardeners Roehampton.
6. Pricing and Payments
Gardeners Roehampton may charge for Services on either a fixed price basis or an hourly rate, depending on the nature of the work. Any initial price indication is based on the information provided by the Client and may be adjusted if the actual work required is significantly different from what was originally described.
For fixed price work, the agreed price will cover the specified scope of Services. Any substantial changes, additional tasks, or extra materials requested by the Client may incur additional charges, to be agreed before such work is carried out. For hourly rate work, the final charge will be based on the actual time spent on site, rounded to reasonable increments.
Gardeners Roehampton may require a deposit or prepayment for certain Services, particularly for larger projects, materials-intensive work, or at busy periods. Any deposit will be set off against the final invoice. Gardeners Roehampton will inform the Client of applicable payment methods and any required payment schedule at the time of booking.
Unless otherwise agreed in writing, payment is due immediately on completion of the Services or on receipt of invoice. Where an invoice is issued with payment terms, the Client must pay in full within the period shown. Gardeners Roehampton reserves the right to apply interest or administrative charges on overdue accounts in accordance with applicable law.
7. Cancellations and Rescheduling
The Client may cancel or reschedule a booking by giving Gardeners Roehampton reasonable notice. Gardeners Roehampton will specify the minimum notice period required at the time of booking. As a general guide, cancellations made with less than twenty four hours' notice may be subject to a cancellation fee, which will usually be a reasonable proportion of the expected charges for the visit.
If the Client repeatedly cancels or reschedules bookings at short notice, Gardeners Roehampton may require a non-refundable deposit for future appointments or may decline to accept further bookings.
Gardeners Roehampton reserves the right to cancel or postpone a booking due to factors beyond its control, including severe weather conditions, illness, equipment failure, or other operational reasons. In such circumstances, Gardeners Roehampton will endeavour to provide as much notice as possible and will seek to rearrange the appointment at a mutually convenient time. No compensation will be payable for such cancellations, but any prepayments for the affected visit will either be applied to the rearranged booking or refunded.
8. Materials, Plants and Equipment
Where Gardeners Roehampton supplies materials, plants or other items as part of the Services, these will be chosen with reasonable care and skill, having regard to the Client's requirements, the Property conditions, and seasonal availability. Gardeners Roehampton does not guarantee the lifespan, growth, or future condition of plants, turf, or other living materials, as these depend on factors beyond its control, including weather, pests, diseases, and the Client's ongoing care.
Any specific plant varieties or brands requested by the Client are subject to availability. If chosen items are unavailable or unsuitable, Gardeners Roehampton may suggest alternatives of a similar type and quality, to be agreed with the Client before purchase.
Gardeners Roehampton will provide its own tools and equipment as standard. The Client must not operate or interfere with Gardeners Roehampton equipment without explicit permission. If the Client requests that Gardeners Roehampton uses the Client's own tools or equipment, this is entirely at the Client's risk and Gardeners Roehampton accepts no liability for any damage or malfunction of such items.
9. Waste Removal and Environmental Responsibilities
Gardeners Roehampton will manage green waste, such as grass cuttings, branches, and plant material, in accordance with applicable waste regulations. Unless otherwise agreed, the default approach may include leaving the green waste on site in an appropriate area, placing it in the Client's garden waste bin, or removing a limited quantity as part of the standard service.
Where substantial volumes of waste are generated, including soil, hardcore, or mixed waste, additional charges may apply for removal and disposal. These charges will take into account local disposal costs, transportation, and any regulatory requirements. Gardeners Roehampton will explain the options and associated costs to the Client in advance, wherever reasonably possible.
Gardeners Roehampton complies with relevant environmental rules relating to the transport and disposal of garden waste and will not allow unlawful dumping, burning, or disposal practices. The Client must not request or require Gardeners Roehampton to dispose of waste in a manner that would breach applicable regulations.
10. Health and Safety
Gardeners Roehampton takes health and safety seriously and will endeavour to carry out all Services in a safe and responsible manner. Gardeners Roehampton may refuse to perform any task that it considers unsafe, illegal, or beyond its professional competence or equipment capabilities.
The Client must keep children, pets, and other persons away from the immediate work area while Services are being performed, particularly when machinery or sharp tools are in use. The Client should also ensure that driveways, access paths, and steps are reasonably clear and not unduly slippery or hazardous.
If Gardeners Roehampton identifies any condition at the Property that presents a significant safety risk, it may suspend or modify the Services until suitable measures are in place. Any additional costs incurred in making the work safe may be charged to the Client, subject to prior discussion where practicable.
11. Liability and Limitations
Gardeners Roehampton will exercise reasonable care and skill in providing the Services. However, except where otherwise required by law, Gardeners Roehampton shall not be liable for any indirect or consequential loss, loss of profit, or loss of enjoyment arising out of or in connection with the Services or these Terms and Conditions.
Gardeners Roehampton's total liability to the Client in respect of any claim or series of connected claims, whether in contract, tort, or otherwise, shall be limited to the total amount paid by the Client for the specific Services giving rise to the claim, except in cases of death or personal injury caused by negligence, fraud, or any other liability that cannot legally be limited.
The Client is responsible for informing Gardeners Roehampton of any particular features at the Property that could be damaged by normal gardening activities, such as delicate ornaments, hidden cables, irrigation systems, or recently installed fixtures. Gardeners Roehampton will not be liable for damage to items that were not reasonably visible or disclosed, or that were positioned in areas where gardening tasks could reasonably be expected to take place.
Gardeners Roehampton is not responsible for any deterioration of plants, lawns, or garden features arising from extreme weather, pests, diseases, lack of watering, or failure by the Client to follow aftercare advice.
12. Complaints and Service Issues
If the Client has any concerns about the Services provided, they should raise them with Gardeners Roehampton as soon as reasonably possible, preferably within forty eight hours of the work taking place. Gardeners Roehampton will review the matter and, where appropriate, may arrange a revisit or propose another reasonable solution.
To assist with resolving complaints, the Client may be asked to provide photographs or a clear description of the issue. Gardeners Roehampton reserves the right to inspect the Property before determining whether any further remedial work is required.
13. Intellectual Property
Any designs, planting schemes, plans, or written materials produced by Gardeners Roehampton remain its intellectual property unless otherwise agreed in writing. The Client is granted a non-exclusive licence to use such materials solely for the purposes of implementing and enjoying the Services at the Property. The Client must not reproduce or share these materials for commercial purposes without prior consent.
14. Data Protection and Privacy
Gardeners Roehampton will collect and use certain personal information about the Client, such as name, address, and service details, for the purpose of managing bookings, delivering Services, and administering the business. Gardeners Roehampton will take reasonable steps to keep this information secure and to use it only for legitimate business purposes or as required by law.
The Client's details will not be sold to third parties. However, Gardeners Roehampton may share limited information with trusted partners or subcontractors where this is necessary to deliver the Services or to meet legal obligations.
15. Amendments to Terms and Conditions
Gardeners Roehampton may update or amend these Terms and Conditions from time to time to reflect changes in law, operational needs, or service offerings. The latest version will apply to new bookings and will be made available to Clients on request. Where changes materially affect ongoing agreements, Gardeners Roehampton will take reasonable steps to inform affected Clients.
16. Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services provided, shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter, save that Gardeners Roehampton reserves the right to take proceedings in any other court of competent jurisdiction where necessary to protect its rights or enforce a judgment.
17. Severability
If any provision of these Terms and Conditions is held by a court or other competent authority to be invalid, unlawful, or unenforceable, that provision shall be deemed deleted, and the remaining provisions shall continue in full force and effect.
18. Entire Agreement
These Terms and Conditions, together with any written quotation or specific agreement between Gardeners Roehampton and the Client, constitute the entire agreement between the parties in relation to the Services and supersede any prior understandings or representations, whether oral or written.
